Website Distance Selling Agreement

As per the regulation on the procedures and principles of distance contracts published on 13.06.2003 in the official gazette number 25137, it is mandatory to make an agreement for sales conducted over the internet. The details of the agreement are as specified below.

Website Distance Selling Agreement

1- Parties

The service provider www.exkaorganizasyon.com will hereinafter be referred to as “Agency”.
The person whose name and surname are specified in the reservation and/or the individuals they represent will be referred to as “Consumer”.

2- Subject

This agreement is made between the Consumer and the Agency.
It is regulated for the sales of services made in writing, visually, by phone, and electronically, covering the rights and obligations of the parties, involving the services sold by the Agency, which are specified below in their qualities and sales conditions.
It encompasses the transfer, tour, and vehicle allocation services purchased by the Consumer from the Agency's website, with the qualities of the purchased service and the service fee specified in the Website Distance Selling Agreement and “Service Agreement” pages, and the reservation and confirmation form sent to the email address.

3- Duration of the Agreement

This agreement comes into effect on the date the reservation is confirmed by the Agency and will automatically terminate when the Consumer's service ends, provided no dispute arises. In case of a dispute, this agreement relationship will remain valid until the final resolution of the dispute.

4- Payment and Invoice Information

The Consumer is obliged to pay the service fee at the time of reservation when purchasing the service with a credit card.
The prices indicated in the service fee include VAT.
Making the reservation and payment implies acceptance of the provisions stated on the Agency's Website Distance Selling Agreement and “Service Agreement” pages.
Complaints and refund requests must be communicated to us within 14 (fourteen) days after the service date.
The period for issuing an invoice for the purchased service is 7 days including the purchase date, provided that it does not exceed a month, as per the V.U.K. requirements.

The Agency will use the information provided in the reservation form to document the invoices sent to the Consumer.
Upon request for an invoice, it will be sent to the address specified in the reservation form by cargo, with payment due upon receipt.
For payments made through Iyzico, the transaction (commission) fee taken by Iyzico is added to the service fee on the Iyzico payment page, and the commission amount is borne by the customer.
Similarly, for refunds through Iyzico, the transaction (commission) fee taken by Iyzico is deducted from the Iyzico payment service fee, and the commission amount is borne by the customer.
In credit card payments, the interest difference determined by the related bank or payment systems for the installment payment options chosen by the customer is added to the service fee and is automatically indicated in the installment payment table.
The costs arising from the cancellation and refund transactions of credit card payments made to the bank's POS system or to the company providing payment system services will be deducted from the amount to be refunded, and these costs will be borne by the customer.
The transaction fee charged by the bank for refunds of payments made by bank transfer will be deducted from the service fee, and the transaction cost will be borne by the customer.
On our website, only prepayment option may be available for some vehicles.
For the vehicles indicated as prepayment required on the reservation page of our website, it is mandatory to make the reservation at least 72 hours in advance based on the local time of Turkey; by making a reservation, the limitation regarding the time is considered accepted.
For requests for the specified vehicles less than 72 hours, it is necessary to contact us to obtain preliminary approval.
Only prepayment option may be available for some destinations on our website.
For international bank transfers, commission charges may be deducted by the sending bank or correspondent banks due to international financial agreements or the commission policies of the sending or correspondent banks.
The responsibility and charges for commission deductions arising from the bank to which the money transfer will be made belong to the sender.
To avoid such situations, please confirm with your bank.

5- Cancellation and Changes

If the Consumer requests a cancellation up to 12 hours before the service begins, the full amount paid for the service will be refunded.
For cancellation requests made less than 12 hours before the service begins, 50% of the one-way service fee will be refunded. (If a round-trip service fee has been paid, the full return fee will be refunded)
These conditions do not cover promotional services, early reservations, or discounted reservations.
Cancellation terms apply to date changes made by the Consumer.
The Consumer agrees to adhere to the service contract rules provided by the Agency; to respect the life, property, and peace of third parties; otherwise, they will not be able to receive the service for a justified reason and will not have the right to a refund.
If the Consumer's credit card, not due to the fault of the Agency, is used unlawfully or unauthorized by third parties after the performance of the service and the bank or financial institution does not pay the service fee to the Agency, the Consumer is responsible for the service fee and any resulting damages.

6- General Provisions

The Agency will try to provide an alternative vehicle as soon as possible and/or inform accordingly from the moment it realizes that it cannot perform your transfer due to mechanical failure in the transfer vehicle, traffic accident, operational malfunctions, adverse weather conditions, traffic congestion, terrorist events, practices of law enforcement forces, etc.
In the situations mentioned above, the transfer fee paid will be refunded to you without any deduction, and/or in such a case, the price difference arising from the transportation you have arranged with your own means will also be paid by the Agency to the Consumer.
In cases of partial or complete non-compliance with the contract by the Agency, the compensation to be paid will be calculated according to the TURSAB TABLE articles.

7- Effectiveness

This contract consists of 7 main clauses and, if necessary, will be drawn up in 2 copies and signed by the parties, and in disputes arising from the contract, the articles of the Law No. 4925 on Road Transport will be applied. In case of disputes arising from this contract, Bodrum courts and enforcement offices will be authorized.
I declare that I have read and accepted the contract on my behalf and/or on behalf of the individuals specified in the reservation form.
This declaration is valid even if the reservation process has been carried out or signed by someone else on my behalf.
As the Consumer, I declare that I accept all the provisions specified in the Website Distance Selling Agreement and the "Service Agreement" pages prepared in my name, take responsibility for the accuracy of the information provided in my reservation form, and acknowledge and accept the information on the Agency's website and the provisions of the Law No. 4925 on Road Transport.
